The "State" of Taiwan, or the Republic of China, exercises and possesses "de facto sovereignty", which is rested with the peoples of "Taiwan", based on the ROC Constitution, and especially based on the international law on fundamental human rights, as below..

Thus, according to Alain Pellet, a Professor at the University of Paris X-Nanterre and a Member and former Chairman of the International Law Commission of the United Nations, the State sovereignty has been restricted rather severely for many years, by the fundamental human rights.
3) Therefore, we, individuals, all are entitled to the fundamental hulman rights, by virtue of the international law, in fact over the State sovereignty. So, Taiwan's sovereignty is rested with us, exercised by the Taiwan de facto State's Republic of China Governemnt, for us, given to it by us, in my estimation. We directly elected and appointed the ROC President, so he is Taiwan de facto State's president. I think, our fundamental soverengty and human rights are violated by the overwhelming international and world States, and directly by PRC and USA, forcing us to keep the title of ROC, its Constitution, and its flags. Under this circumstatnces, it's NOT possible for USA to "resume military trusteeship" over Taiwan, I think.
I think, we should support our President and Government to change them as far as possible, WITHOUT causing military confrontation and war from China. """
